1. Scope
(1) These Terms & Conditions apply to all contracts for digital products, online courses, programs, live online sessions, and—if offered—live events/retreats and 1:1 services between: The Orgasmic Brain

and the customer (“Customer”).
(2) Any conflicting terms of the Customer do not apply unless the Provider explicitly agrees in writing.
2. Services
(1) Services may include:
a) digital content (videos, audios, PDFs, downloads),
b) self-paced or guided online courses/programs,
c) live online sessions (workshops, webinars),
d) 1:1 sessions (if offered),
e) live events/retreats (if offered).
(2) The specific scope, duration, access period, and content are described on the respective sales page.
3. Purchase & Contract Formation (Kajabi)
(1) Digital products are sold and delivered via Kajabi (Kajabi, LLC, 15495 Sand Canyon Ave, Suite #300, Irvine, CA 92618, USA). Access is typically granted through Kajabi.
(2) A contract is formed once the Customer completes checkout and payment is confirmed.
(3) The Customer receives confirmation and access details via email and/or through their Kajabi account.
4. Prices & Payment
(1) Prices shown at the time of purchase apply.
(2) Payments are processed through the payment methods offered in checkout (e.g., Stripe/credit card, PayPal).
(3) If installment plans are available, the total amount may be higher; details are shown at checkout.
(4) Access may be suspended if payments fail or are overdue.
5. Access, License, Account Security
(1) Login details are personal and must not be shared.
(2) The Customer receives a limited, non-transferable, non-exclusive license for personal, non-commercial use.
(3) Reproduction, resale, redistribution, uploading, public sharing, or making content available to third parties is prohibited.
(4) In case of misuse (e.g., sharing logins), access may be revoked without refund; further claims remain reserved.
6. Delivery of Digital Content
(1) Digital content is provided electronically after successful payment (Kajabi access/download).
(2) The Customer is responsible for having suitable devices, software, and internet access.
7. Right of Withdrawal (EU Consumers) & Digital Content
(1) EU consumers generally have a 14-day right of withdrawal.
(2) For digital content, this right may be lost once the Customer:
a) expressly requests immediate performance before the withdrawal period ends, and
b) acknowledges that the right of withdrawal is thereby forfeited (according to applicable EU/German consumer law where relevant).
(3) The necessary consent is collected during checkout.
8. Health Disclaimer / No Medical Advice
(1) The content is provided for educational and self-exploration purposes only and is not medical advice.
(2) No guarantees or promises of outcomes are made; results vary individually.
(3) If the Customer has medical conditions, is pregnant, takes medication, or has mental health concerns, professional medical advice should be sought before participation.
9. Liability
(1) The Provider is liable without limitation for intent and gross negligence and for injury to life, body, or health.
(2) In cases of simple negligence, liability is limited to breaches of essential contractual obligations and to foreseeable typical damages.
(3) No liability is assumed for third-party platform downtime or temporary unavailability due to maintenance or technical issues unless caused intentionally or by gross negligence.
10. Live Sessions / Scheduling (if offered)
(1) Live sessions may be rescheduled for good cause (e.g., illness). A reasonable replacement date will be provided.
(2) There is no claim to a session at an exact time if a suitable replacement is offered.
11. Retreats / Live Events – Booking & Cancellation (optional)
(1) Details are defined on the event sales page.

12. Confidentiality & Know-How
(1) All materials, protocols, audios, scripts, and exercises are protected intellectual property and may include confidential know-how.
(2) The Customer agrees not to use the materials beyond the granted license or disclose them to third parties.
13. Data Protection
Data processing is described in the Privacy Policy on the website. For delivery and payment, data is processed via Kajabi and payment providers.
14. Governing Law & Final Provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protections in the Customer’s country of residence apply.
(2) If any provision is invalid, the remainder remains effective.
